Accordingly, the final step in the jurisdictional analysis is to consider whether the court may exercise pendent personal jurisdiction over Creative Controls for any claim over which it lacks specific personal jurisdiction.

Thus, even assuming that the website constitutes an offer to sell under Federal Circuit law, there is no evidence that Creative Controls has ever made an offer to sell an allegedly infringing product to a Utah resident via its website. Without such evidence, the court cannot find that Creative Controls' website creates sufficient minimum contacts with Utah to constitute purposeful availment of the Utah forum. Accordingly, the court lacks specific personal jurisdiction over Creative Controls on all patent-related claims. Specific personal jurisdiction exists only when the plaintiff's claims arise out of the defendant's contacts with the forum. Thus, the court must consider each of Kindig's claims separately to determine whether they arise from any of Creative Controls' contacts with Utah.

Accordingly, venue is proper for the Copyright-Related Claims under 28 U.S.C. § 1391(a), (c)(2) (2012). Additionally, the court is unpersuaded that the Copyright-Related Claims should be transferred to a Michigan court under 28 U.S.C. § 1404 (2012). For the same reasons as set forth in the previous section, the court finds that it is not unfair for Creative Controls to litigate the Copyright-Related Claims in Utah. Master showman Sid Grauman spared no expense when constructing his one-of-a-kind Chinese Theatre in 1927, importing stone figures, bells, pagodas, and sundry Chinese artifacts to give the venue a sense of extravagant grandeur.

The theater was bought and refurbished by Disney subsidiary Buena Vista Pictures Distribution in the 1990s. Its family-friendly screenings frequently include appearances by costumed characters. A moody House of Hackney floral wall covering lines the dressing area, which leads to a powder room accented with a Kelly Wearstler’s Graffito II from Walnut Wallpaper. A black-and-white triangular mosaic tile floor by Artistic Tile from Mission Tile West puts a contemporary twist on the classic checkered pattern. The landmark mansion was built in 1902 by architect Joseph J. Blick for Gertrude Potter Daniels, who paid $15,000 for the shingle-style home. In 1905, Susanna Bransford Emery-Holmes—known as the Silver Queen thanks to the source of her late husband’s fortune—purchased the home and soon made it her own.

The El Capitan often gets overshadowed by the Chinese Theatre across the street, but this little venue is impressive in its own right. Also opened by Sid Grauman, the theater was designed by Morgan, Walls, and Clements—the firm behind several other LA landmarks, including the Wiltern. It originally served as a live theater venue, but deserves a place on any list of historic movie theaters as the place where Citizen Kane made its world premiere in 1941. This 1930's warehouse-turned-theater (complete with an exposed beam ceiling, swoon) hosts performances of all kinds, including music, theater, dance and film. Indie rock bands and local talent are often on tap here, and it's one of the best small music venues on the Eastside.
